Terms governing Pact Breaker
Please read these Terms before using Pact Breaker. They explain the rules between you and Jovian Labs, Inc., including the terms for Pact Breaker credits.
Article 01
1. Agreement to these Terms
These Terms of Service are a legal agreement between you and Jovian Labs, Inc. ("Jovian Labs," "we," "us," or "our"), the operator of Pact Breaker (the "Service").
By creating an account, opening or joining a table, buying or using Pact Breaker credits, or otherwise using the Service, you accept these Terms. If you do not accept them, do not use Pact Breaker.
Article 02
2. Who may use Pact Breaker
You may use Pact Breaker only if you have reached the age of majority where you live and have the legal capacity to enter a binding contract. If you use the Service for an organization, you represent that you have authority to bind that organization to these Terms.
Pact Breaker is not directed to children. We do not add a date-of-birth or age-verification process; eligibility remains your contractual responsibility.
Article 03
3. Accounts and security
Clerk manages Pact Breaker authentication. You are responsible for safeguarding access to your authentication account, using an appropriate public username, and telling us promptly if you believe your account has been compromised.
Your username is visible to people who share a table with you. You may not impersonate another person, misrepresent your authority, sell or transfer account access, or use somebody else's credentials without permission. You are responsible for activity performed through your account unless applicable law provides otherwise.
Article 04
4. The service
Pact Breaker lets adults play an independent implementation of the board game Diplomacy. You may play alone, invite people to an online table, or use one shared board while players take seats from their own devices.
The Service processes simultaneous orders, private and group press, seats, readiness, game history, and shared records. Table owners choose the available settings, and players remain responsible for the orders and messages submitted from their seats.
For all new Solo, Invite, Public, and Room games, human powers are assigned randomly only when the game begins. Before then, Invite and Public rosters identify people without powers, while Room links identify stable Player 1 through Player 7 slots rather than countries. After a game begins, its roster may show the powers assigned to those people or player slots.
Public matchmaking listings describe eligible waiting games without displaying player usernames. A joined waiting public roster may show public usernames, readiness, and the owner role, but not powers before the game begins.
Players at a public table may initiate a boot vote; it passes only when the required private voting threshold is met, and vote identities remain private. Players may also create private blocks that prevent future public matchmaking with another player without changing games they already share.
Ownership may transfer when an owner permanently leaves. A waiting table is canceled, or an active table abandoned, when no human players remain.
For a private table, an owner may ask Pact Breaker to prepare an invitation draft. The owner initiates and sends that draft through the owner's device or chosen app; Pact Breaker does not send the invitation.
Pact Breaker is an independent implementation of Diplomacy's rules. It is not the official game or affiliated with the game's rights holders.
Article 05
5. AI diplomats
AI diplomats are optional. When a table enables them, an AI diplomat may receive and process the game state, history, orders, and press that are available to the power it plays. This can include private messages sent to that power.
AI output can be inaccurate, inconsistent, incomplete, delayed, or unavailable. An AI diplomat may misunderstand a promise, make a poor move, invent a claim, or fail to act. We do not guarantee a particular game outcome, strategic quality, response, or uninterrupted availability.
AI diplomats also depend on third-party services and service limits. An interruption or platform limit may pause AI while human play and saved game state remain available.
Article 06
6. Pact Breaker credits
One Pact Breaker credit equals US$0.01 of prepaid value. The available packs are 500 credits for US$5, 1,500 credits for US$15, and 3,000 credits for US$30. Applicable tax is added at Checkout.
Credits do not expire, cannot be transferred between users, and have no cash value. They may be used only for eligible AI-diplomat features in Pact Breaker.
Credits begin in your Account balance. Choosing credits for a game transfers that amount from Account to the game, with a minimum of 100 credits. "Recommended" is an estimate based on the selected model and is not a guarantee of total game usage.
Credit usage varies with the selected model and the amount of AI-diplomat activity. Every player in a game may see the credits added, used, and left in that game, but only the owner sees the owner's Account balance.
Unused game credits return to the owner's Account when AI is turned off, the game changes to the owner's OpenAI key, the game completes, or the owner voluntarily gives up ownership. Account deletion is different: unused Account and game credits are forfeited without refund.
Article 07
7. Payments and refunds
Stripe handles Checkout and payment processing. Prices are shown in US dollars, and taxes may be calculated from the billing information collected at Checkout.
All sales are final and non-refundable except where applicable law requires otherwise. Deleting an account forfeits unused credits. A refund, reversal, chargeback, dispute, or suspected payment abuse may revoke associated credits and pause new purchases or credit-funded AI diplomats while the matter is reviewed.
A Checkout redirect or browser status message does not itself add credits. Pact Breaker adds credits to Account only after receiving and verifying Stripe's signed payment confirmation.
Article 08
8. Player content and conduct
You retain ownership of content you submit, including table names, orders, and press. You give Jovian Labs a limited, non-exclusive licence to store, reproduce, display, transmit to intended participants, and process that content through service and AI providers only as needed to operate, secure, support, and improve the Service or comply with law.
Deception inside the strategy of a game is permitted. That does not permit harassment, threats, unlawful content, exploitation, abuse, interference with the Service, credential misuse, impersonation, unauthorized access, malware, scraping that disrupts the Service, or attempts to evade security or purchase limits.
You represent that you have the rights needed to submit your content and that your use of Pact Breaker will comply with applicable law and these Terms.
Article 09
9. Privacy and shared records
Our Privacy Policy explains how Pact Breaker handles personal information and how AI-enabled tables share relevant game context with OpenAI.
A game is a shared record. If one player deletes an account, the game may remain available to other participants who retain it. Pact Breaker removes the deleted account's displayed identity and marks the former participant as a deleted player, but does not erase the other participants' shared game history.
Article 10
10. Ownership
Jovian Labs and its licensors retain all rights in Pact Breaker's software, interface, artwork, original characters, text, branding, and other Service materials, except for player content and third-party material identified with its own licence.
These Terms do not transfer ownership to you. They give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You keep ownership of content you submit, subject to the limited operational licence above.
Article 11
11. Availability, suspension, and termination
We may maintain, change, suspend, limit, or discontinue any part of the Service. Outages, maintenance, model-provider limits, billing locks, or other failures may interrupt access or AI operation. We will try to preserve game state where the Service is designed to do so, but we do not promise uninterrupted availability.
We may restrict or terminate access when reasonably necessary to protect players or the Service, enforce these Terms, comply with law, address security or payment risk, or respond to abuse. Where appropriate, the restriction may apply only to purchases or credit-funded AI diplomats while games using a personal OpenAI key and human play remain available.
You may stop using Pact Breaker or delete your account through the Account controls. Deletion has the effects described in these Terms, including credit forfeiture and preservation of shared records for other participants.
Article 12
12. Disclaimers and liability
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded. Subject to those rights, Pact Breaker, AI diplomats, and all content are provided "as is" and "as available." We disclaim implied warranties to the fullest extent permitted by law, including fitness for a particular purpose, merchantability, accuracy, and non-infringement.
To the fullest extent permitted by law, Jovian Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or game outcomes arising from the Service.
To the fullest extent permitted by law, Jovian Labs' total aggregate liability arising from or relating to Pact Breaker will not exceed the total amount you paid to Jovian Labs for the Service during the twelve months immediately before the event giving rise to the claim. Any limitation applies only to the extent permitted in your jurisdiction.
Article 13
13. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to mandatory consumer protections, you and Jovian Labs submit to the courts located in Ontario for disputes relating to these Terms or the Service.
These Terms do not require arbitration and do not include a class-action waiver. If the law where you live gives you mandatory rights or permits you to bring a claim in another forum, those rights remain available.
Article 14
14. Changes and contact
We may revise these Terms as the Service or law changes. Material revisions will receive a new effective date, and we will provide any notice required by law. Your continued use after revised Terms take effect means you accept them where applicable law permits.
